Rental Agreement
This Rental Agreement ("Agreement") is entered into between the Lender ("Lender") and the Renter effective as of the date of rental request.
By agreeing to the Rental Agreement, you are agreeing to the following Terms of Rental:
- Rented Item: Upon accepting the rental request, the Lender agrees to rent out the item(s) in the condition stated in the product description(s) and photos.
- Condition of Items: The Renter acknowledges receiving the item(s) in the condition as described in the listing and agrees to return the item(s) in the same condition, except for reasonable wear and tear. "Reasonable wear and tear" refers to normal, minimal deterioration of the item(s) that occurs during proper use, excluding damage caused by misuse or negligence.
- Liability for Damages or Losses: The Renter shall be liable for any damages, loss, or theft of the rented item(s) during the rental period. The Renter agrees to pay for any repair costs or replacement value in the event of damage, loss, or theft. "Replacement value" refers to the cost of replacing the item(s) with an identical or similar item(s) in the same condition as when rented.
- Inspection and Documentation: Upon receiving the item(s), the Renter shall inspect and document any existing damages or discrepancies, communicating these within 24 hours of receipt. The Renter agrees to promptly notify the Lender and provide necessary documentation if any damages occur during the rental period. Documentation may include photographs, written descriptions, or other relevant evidence of damage.
- Responsibility of Care: The Renter shall handle the rented item(s) with care and take reasonable precautions to prevent damages or loss during the rental period. The Renter shall avoid exposing the item(s) to conditions that may cause damage, such as water, extreme heat, chemicals such as bleach, or any other circumstances that could harm the item(s).
- Resolution of Damages or Losses: In the event of damages, loss, or theft of the rented item(s), the Renter agrees to discuss and agree upon a resolution with the Lender, which may include repair costs or replacement value. If the Renter fails to reach an agreement with the Lender, the Renter acknowledges the right of the Rental Platform to charge the Renter's payment method on file for the repair costs or replacement value.
- Agreement Acknowledgment: By renting the item(s), the Renter acknowledges and agrees to be bound by the terms and conditions outlined in this Agreement.
- Governing Law: This Agreement shall be governed by the laws of Ontario Canada without regard to its conflict of law principles.
